Warranty Information
LIMITED WARRANTY
Designmaster provides this limited warranty for the products we manufacture, warranting that those products are free from defects in material and workmanship under normal use and service as described below.
This limited warranty exists for one year from the date of invoice. This limited warranty applies exclusively to the benefit of the authorized Designmaster dealer and/or end user of the product under conditions of normal use only and will terminate in the event of resale. This limited warranty is inclusive of frame, finish, and metal component parts in its original manufactured construction. Any product modifications by dealer, purchaser, or end user, or use of non-Designmaster parts, voids this limited warranty. This limited warranty does not apply to damage resulting from (a) normal wear and tear; (b) negligence, abuse or misuse; (c) inadequate or improper maintenance, cleaning or care; (d) exposure to sunlight; exposure to chemicals and/or other liquids; (f) pets; (g) any use of which the product was not designed; (h) transportation or delivery; (i) or damage caused by a carrier, dealer, installer, or any other third party. Because of the craftsmanship involved and the nature of the materials used in the manufacturing process, minor variations will occur from piece to piece. Therefore, this limited warranty does not cover such minor differences between the furniture invoiced and floor samples, printed illustration, and video or internet displays. Nor does this limited warranty cover any product designated “as is” at the time of purchase.
Designmaster may examine the product and will decide, at its sole discretion, if it is covered under this limited warranty. If considered covered, the Company will either repair any defective part of the product or provide an appropriate replacement without charge to the original purchaser. If the Company decides to replace a product it no longer sells, the Company will provide an appropriate replacement of equal or lesser value. It is the Company that determines, at its sole discretion, whether a product should be repaired or replaced and what constitutes an appropriate replacement. Any product repaired or replaced will itself by warranted only for the remainder of the warranty period of the original product.
This limited warranty does not cover any cost associated with shipping, handling, temporary rental of furniture, and the installation of repaired and replaced products, unless approved in writing by Designmaster.
COM Fabrics and COL Leather – Inasmuch as a Designmaster product has been upholstered with upholstery covering provided by the Purchaser of the product (“Customer’s Own Material or COM; Customer’s Own Leather or COL), Designmaster makes no express or implied warranty in regard to the Purchaser’s provided upholstery material, whether as to its design or construction, its appropriateness or fitness to be applied to the product, its performance characteristics, or otherwise.
Designmaster Fabrics – Designmaster fabrics are not covered by this warranty. Manufacturers of upholstery fabrics do not guarantee their products for more than one year for problems related to shrinkage, color fastness, and wear. Therefore, warranty claims on fabrics will not be accepted.
Stated Dimensions – Designmaster products are all bench-made by hand. All measurements and weights are approximate and are subject to some variation.
Corrosion and Oxidation of Metal Parts – Corrosion and oxidation of metal are not covered by this limited warranty. These occurrences can happen when metal is exposed to salt air, salt water spray, or airborne chemicals like chlorinated pool water, so original purchasers should avoid exposure of metal parts to these conditions.
WARRANTY CLAIMS
All warranty claims must be submitted in writing within thirty days of the first notice of product failure. The original Purchaser must submit the claim to Customer Service by emailing their internal Designmaster customer service representative. The claim must include a valid copy of the paid in full invoice. It is the responsibility of the original purchaser to provide all relevant proof of care and maintenance, photographs, use by end user(s), and other evidence, which may support the claim. Designmaster may deny any claim when the original Purchaser does not provide relevant and complete information in a timely manner upon request by Designmaster. Local repairs must have prior written approval from Designmaster. Defective products may not be returned to Designmaster without an official Return Authorization (RA#) from Designmaster and any attempt to do so will void the warranty.
EXCEPT AS STATED HEREIN, DESIGNMASTER MAKES NO EXPRESS OR IMPLIED WARRANTIES AS TO ANY PRODUCT, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. THIS LIMITED WARRANTY IS EXCLUSIVE AND IN LIEU OF ANY OTHER EXPRESS OR IMPLIED WARRANTIES OR REMEDIES, CONIDITIONS, OR GUARANTIES, ALL OF WHICH DESIGNMASTER DISCLAIMS. DESIGNMASTER SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR FOR ANY COMMERCIAL LOSS ARISING FROM THE USE OR INABILITY TO USE ANY DESIGNMASTER PRODUCT.
Designmaster is a North Carolina corporation whose principal office and place of business is located in Hickory, North Carolina. This limited warranty is made in the State of North Carolina, and to the fullest extent permitted by law it shall be governed by and construed under the laws of the State of North Carolina. Some states do not allow limitation on how long an implied warranty will last or the exclusion or incidental or consequential damages or provide other specific legal rights, so the above limitations may not apply.
